The Guide details and analyses Public and Private law provisions within the Children Act 1989 (as amended and extended by the Adoption and Children Act 2002; the Children Act 2004 and the Children and Adoption Act 2006 and the Children & Young Persons Act 2008), Court Rules and Regulations, Practice Directions, Guidance, Circulars and decisions in the courts. The Human Rights Act 1998 and the European Convention on Human Rights are incorporated within the Guideas are the Public Law Outline; the Practice Direction "Experts in Family Proceedings Relating to Children" and the Allocation and Transfer of Proceedings Order 2008.
The Guide is updated monthly to ensure that Guides received by new subscribers are completely up-to-date.

Procedure governing applications for orders; transfer of proceedings; bundles and documentary evidence; directions hearings; instruction of experts; interim & final hearings; costs and appeals.

Chapter 2
Appointment and duties of CAFCASS officers in Private and Public law proceedings; appointment of CAFCASS and private practice Solicitors as the Guardian-ad-litem for children in Private law proceedings; appointment of Solicitor for the child in Public law cases; Law Society guidance for Solicitors where a Children's Guardian has not been appointed.

Newsletters also keep track of developments under the Adoption and Children Act 2002.

  • The Children Act 1989 in action - an analysis of recent developments relevant to the practice of solicitors, barristers and other practitioners.
  • Detail and analysis of decisions in the courts; amendments to Court Rules, Regulations etc. Practitioners' Guides makes regular use of official transcripts of High Court and Court of Appeal decisions, usually providing a detailed report and commentary well in advance of other publications. Recent decisions are related to earlier authorities decided on the same issue, thereby ensuring a comprehensive picture of developments on particular issues.

THE CONSULTANCY SERVICE

Where a question of law or other issue arises in a case which can be discussed & resolved by way of a telephone conversation, subscribers may telephone Practitioners' Guides and discuss the matter with the author or, if he is not immediately available, leave a message to which he will respond on the following day at the latest.
